Banzhoff Tract

  • Land Use Appeal: 2015-03106 Civil Term, Court of Common Pleas, Cumberland County, PA.  On January 21, 2016, the Cumberland County Court of Common Pleas has upheld the Township’s condition of approval of the Banzhoff Preliminary Land Development Plan requiring the developer to construct a second access road from the development under Route 15 onto Gettysburg Pike.  Senior Judge J. Wesley Oler, Jr. concluded that the developer failed to establish that a public or private road could not be constructed under Route 15 thereby enabling it to construct an emergency access road instead.  The Court found the condition of approval (Condition No. 2) to be both appropriate to effectuate compliance with Section 220-29 of the Subdivision and Land Development Ordinance (SALDO) and reasonable in order to make the plan compliant.  The Court did, however, sustain the developer’s objection to Condition No. 5 regarding the configuration of Loop Road.  It also struck Condition No. 14 regarding the payment of fees to the Township Recreation Land Acquisition or Improvement Fund as being applicable to final plan approval but not a proper condition of approval of a preliminary plan.

Appeal Update: On February 19, 2016 the Applicant filed an appeal of Cumberland County Judge Oler's decision to the Commonwealth Court of Pennsylvania.  Appeal pending.

Terraces at Shepherdstown

Messiah Village - Envision Project
